WHAT MAKES A GOOD IMMIGRATION LAWYER

A good attorney is a person who is licensed by, and in good standing with, the Bar of one of the states or the District of Columbia. Because Immigration Law is federal, a person who is licensed in any state can practice immigration law here in California. Under professional rules of conduct, an attorney must:

Be YOUR advocate, and help you resolve your legal problems
NEVER guarantees results – the final resolution of your case is not up to your lawyer, another person(s) will be the final decision-maker in your case.
Offer you a WRITTEN agreement, which describes the scope of the work to be done and the fees and other costs to be paid
Explain the steps to be taken in your case and an expected timeline for results
BE AVAILABLE to you – while immigration lawyers are extremely busy these days, your lawyer must always make time to speak with you about your case. Please confirm with your lawyer the best method of communication and how to schedule appointments
PROVIDE YOU WITH YOUR OWN DOCUMENTS. An attorney will never request, nor take possession of your personal, original documents. You have a right to receive a copy of any and all applications, petitions, or communications made on your behalf by the attorney with any government or other agency at any time, for any reason. While the attorney may charge you a reasonable amount to make copies or send your file to you, the attorney may not charge extra to provide you with a copy of your own file.
BE HONEST. Your attorney will honestly describe the options available to you (even when there might not be any good options), and the potential risks and benefits of each option.
SERVE YOU. A good lawyer will explain your options, but YOU are in control of the case and YOU make the final decision about which option(s) you want to pursue. Your immigration case is YOURS, not the attorneys. YOU have the power to decide.

WHAT MAKES A GOOD DOJ ACCREDITED REP

Over 60 years ago, the U.S. federal government recognized that there were not enough qualified legal representatives for all the people who needed them, especially for low-income immigrant communities. The response was the creation of the Recognition & Accreditation Program. Through this program, under the U.S. Department of Justice, non-attorney “Accredited Representatives” are permitted to represent non-citizens before the Department of Homeland Security (DHS) and the Executive Office for Immigration Review (EOIR), which includes the immigration courts and the Board of Immigration Appeals (BIA). These representatives are accredited through the R&A Program, which aims to increase the availability of competent immigration legal representation for low-income and indigent persons, thereby promoting the effective and efficient administration of justice. Accredited Representatives may only provide immigration legal services through Recognized Organizations. Only non-profit, federally tax-exempt entities may apply to be recognized.
